TERMS & CONDITIONS

These are our Terms and Conditions for trading through this website. They are by necessity comprehensive to ensure that you are fully protected.

Murray Close Photography is the shopfront of Pigs Ear UK Ltd., trading as Murray Close Photography. In order to comply with the European Union (EU) Directive on Distance Selling, the following Terms & Conditions must be agreed to before your order can be processed.

RIGHTS
Statutory Rights: Your statutory rights are not affected by any clause in these Terms and Conditions or elsewhere in the Island Focus website

GUARANTEE
Guarantee of Quality: Island Focus guarantees that all products contained in our goods are of the highest quality, meet current EU legislation standards, and that the products meet the required standards for the purpose they were intended.

CANCELLATION
Cancellation Policy: You have the right to cancel your order for any reason within 7 working days from the day after receiving delivery of your order but must contact Murray Close Photography by email (info@murrayclose.com) to inform us of your decision. Under such circumstances you will be required to pay for first class return postage with insurance to the retail value of the product and this will be deducted from any refund due to you. This will be the only deduction made and the balance will be returned to you within 30 days from cancellation.

PAYMENT
Payment Options: Murray Close Photography accepts payments by credit/debit card only.

RETURNS
Returns Procedure: Murray Close Photography makes every effort to ensure goods arrive in perfect condition. However, in the unlikely event of a product not being delivered within 14 working days from the despatch date customers should advise by e-mail. Murray Close Photography will make every effort to locate the goods, and if necessary, send a replacement at our expense or provide a full refund. If goods arrive damaged in any way, customers should contact Murray Close Photography within 7 days of receipt. This does not affect your statutory rights as a consumer.

REFUNDS
Refunds: Refunds for valid claims will be made via the same method of payment as used to place order.

DELIVERY
Delivery Methods & Times: Deliveries within the United Kingdom are made First Class Post , unless express delivery is requested. For more information about delivery time for the rest of the world see Shipping Information.

RETENTION
Retention of Title: This remains with Murray Close Photography until the goods are paid for in full.

CHARGES
Delivery Charges: These are automatically added to the cost of the goods as part of the process of submitting an order.

INSURANCE
Insurance: Liability insurance is included.

TAXES
Responsibility for Local Taxes & Duties: These are the responsibility of the shopper or recipient in the country of destination.

VAT
Application of Value Added Tax (VAT): VAT at standard rate is added to the displayed cost of the goods, where applicable (VAT number: 825 939393).

CONFIRMATION
Order Confirmations: Upon submitting an order using our automated shopping basket system you will receive a 'result of your feedback form' as an e-mail. Please check that the details contained in this email are correct. If there are any mistakes in your order, please email us immediately. This e-mail is a copy of your order as sent and is neither an invoice not a formal acceptance of your order. All orders placed with us will be confirmed by an Order Confirmation e-mail that will show the despatch date , and where applicable, tracking number. A Despatch Note (or Invoice to trade customers) will follow by post. In the unlikely event of us being unable to fulfil an order placed (due to having sold out of an item or goods selected), we will advise you as soon as possible . If payment has been made on an order that we are unable to fulfil we will immediately refund payment by the same method as the payment made.

PRIVACY
Privacy and Data Protection: Murray Close Photography collects any information given about you during the course of the ordering and registration process. We keep this information on record to assist our administration and for future marketing initiatives. We do not sell or pass to anyone information contained on customers, which remains confidential to the company. All data is collected lawfully and in accordance with the Data Protection Act 1998. We do not send out marketing material unless you consent by ticking the appropriate box during the ordering process. Any concerns over privacy may be addressed by email to info@murrayclose.com.

SUBSTITUTIONS
Substitutions: Whilst every effort will be made to supply the items as specified, the contents of an order are subject to availability. Murray Close Photography reserves the right to substitute items of similar or higher value, where appropriate, should the need arise. Under these circumstances you have the option to accept or decline the substitute goods.

UNFORSEEN CIRCUMSTANCES
Unforeseen Circumstances: While every effort will be made to meet shoppers demands; cancellations or variations may be necessary as a result of Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of Murray Close Photography.

Terms and Conditions of submission and reproduction of pictures to business, corporate or other organisation or Agent(s).

In this agreement the terms a) Supplier, shall mean Murray Close Photography, b) Picture, includes a photograph, transparency, negative, print, design, artwork, etching, montage, drawing or any other item which may be offered for the purposes of reproduction, c) Reproduction includes any form of publication or copying of the whole or part of any picture, altered or not, whether by printing, photography, slide projection (whether or not to an audience), xerography, artists reference, artists illustration, layout or presentation, electronic or mechanical reproduction or storage by any other means;

Pictures are supplied on loan and no property or copyright in any picture shall pass to the Client whether on its submission or on the Suppliers grant of reproduction rights in respect thereof.

Reproduction rights if and when granted are strictly limited to the use, period of time and territory specified on the Suppliers subsequent invoice and unless otherwise agreed in writing relate to a single publication in a single size with text (if any) in one language only.

Risk in and responsibility for pictures passes to the Client from the time they are received until their safe return. The Client shall immediately inform the Supplier in writing of any known loss or misuse of, or damage to the pictures while in the Clients possession or that of any third party. If a picture is not returned the Supplier may in its sole discretion presume the picture(s) to be lost.

The Client shall be liable to pay compensation to the Supplier in respect of each picture lost or damaged. Payment of compensation does not give rise to any rights in any picture. The figures have been assessed by the Supplier and are a genuine pre-estimate of the loss which would be suffered if such a picture were to be lost or damaged. The compensation per picture shall be a minimum of £500 per lost or damaged picture plus any reasonable expenses incurred and VAT.

COMPLAINTS
Complaints: Any complaints should be made by email to info@murrayclose.com. We endeavour to respond to all complaints within 5 working days.

SECURITY AND PROTECTION
Security and Protection for online transactions: All online payments are made through Protx, the following is an extract from their security statement:

"All transaction information passed between merchant sites and the Protx VSP Systems is encrypted using 128-bit SSL certificates. No cardholder information is ever passed unencrypted and any messages sent to your servers from Protx are signed using MD5 hashing to prevent tampering. You can be completely secure in the knowledge that nothing you pass to the Protx servers can be examined, used or modified by any third parties attempting to gain access to sensitive information.

Protx has multiple private links into the banking network that are completely separate from the Internet and which do not cross any publicly accessible networks. Any cardholder information sent to the banks and any authorisation message coming back is secure and cannot be tampered with.

No individuals within Protx are able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). Your transaction information and customer card information is secure even from our own employees because our systems never display the full card numbers, even on administration screens."
